Monica LIU is a senior associate specialized in labor law and contract law. She has been primarily engaged in legal services related to corporate compliance, labor disputes and labor and personnel management for the past decade. She has accumulated a wealth of practical experience and creative solutions in the construction of corporate compliance systems, the management of employee relations and the labor disputes. 

Monica has provided legal services, especially on labor issues, for listed companies and corporations engaged in different sectors. Having handled hundreds of labor disputes over the years, she has accumulated extensive experience in dealing with labor disputes and has been deeply involved in both litigation and non-litigation cases in the field of labor law, and thus is very familiar with labor policies and skilled in applying rules and regulations.

Monica obtained a bachelor’s degree at Shandong University in 2010 and a master’s degree at the East China University of Political Science and Law in 2013. She passed the China Bar Examination in 2013.

Providing advice regarding the termination of employment contracts or labor relationships.

Advisory on health and safety operations and work-related accident management.

Streamlining labor relationships, including relationships with the labor unions.

 

Business reorganizations:

Employment law due diligence for mergers and acquisitions.

Employment law advice related to transactions such as sales, spin-offs, mergers, business transfers, changes of control, etc.

Designing employment preservation plans, preparing related documents and providing advice regarding the implementation of the preservation plan.

 

Labor Disputes:

Providing settlement suggestions and participating in non-judicial negotiation, mediation and conciliation regarding labor disputes.

Representing clients during labor arbitration and litigation.

 

Legal Audit and Compliance Investigation:

Conducting internal investigations regarding fraud, corruption and other misconduct of the management and related employees.

Conducting compliance audits regarding employment management.

 

Training Services:

Providing knowledge and hands-on training on labor laws and regulations.

Providing anti-bribery & corruption training and other compliance trainings.

Providing trade secrets protection training.

 

【Representative Matters

Represented an established German cross-border e-commerce company in a number of labor disputes with senior executives who had been working for the company for more than 20 years,  and all of the executive's claims were not supported at the end of the case;

Represented a Belgian group in a non-competition dispute with an executive, and won the case after arbitration, first trial and second trial, and the case has been cited in many articles in the field of justice and lawyers;

Represented a listed subsidiary of a world-famous pharmaceutical company in a labor dispute with a senior employee due to serious disciplinary reasons, and successfully filled the company's procedural deficiencies by interpreting and skillfully applying the employee handbook and corporate policies, and won the case;

Successfully assisting a European company to relocate its WFOE from Shanghai to other city smoothly, in particular the employees’ arrangement and labor disputes resolution;

Successfully assisting a French high-tech Company with the employment preservation and transfer plan;
